These Hire Terms apply to all bookings and hire arrangements made with Khaoz Rentals (“Khaoz Rentals”, “we”, “us” or “our”) for the hire of our cool rooms, refrigerated trailers and related equipment (“Equipment”).
By making a booking with Khaoz Rentals, the customer (“Customer”, “you” or “your”) agrees to be bound by these Hire Terms.
1. Booking
1.1 A booking is confirmed once the required booking information has been provided and payment has been successfully received.
1.2 The Customer must provide accurate and complete information when making a booking, including the delivery address, booking dates, contact details and any other information reasonably required by Khaoz Rentals.
1.3 Khaoz Rentals reserves the right to decline or cancel a booking where the requested Equipment is unavailable, unsuitable for the intended location or use, or where we reasonably consider that the hire cannot be safely or appropriately completed.
2. Hire Period
2.1 The hire period begins on the agreed delivery or handover date and ends on the agreed collection or return date.
2.2 The Equipment must remain available for collection at the agreed time and location at the end of the hire period.
2.3 Any extension of the hire period must be approved by Khaoz Rentals before the original collection date.
2.4 Additional hire fees may apply where the Customer keeps the Equipment beyond the agreed hire period without prior approval.
3. Delivery and Collection
3.1 Khaoz Rentals may deliver and collect the Equipment from the address provided by the Customer at the time of booking.
3.2 The Customer must ensure that the delivery and collection location is reasonably accessible and suitable for the Equipment.
3.3 The Customer is responsible for informing Khaoz Rentals of any access restrictions, gates, narrow driveways, stairs, parking restrictions or other conditions that may affect delivery or collection.
3.4 If delivery or collection is delayed because the Customer is unavailable, the location is inaccessible, or the Customer has not provided accurate information, additional fees may apply.
3.5 Khaoz Rentals may refuse delivery or collection where the location is considered unsafe or unsuitable for the Equipment.
4. Use of the Equipment
4.1 The Equipment must only be used for its intended purpose as a refrigerated/cool storage facility.
4.2 The Customer must use the Equipment carefully and in accordance with any instructions provided by Khaoz Rentals.
4.3 The Customer must not modify, dismantle, relocate, repair or interfere with the Equipment without prior approval from Khaoz Rentals.
4.4 The Customer must not allow unauthorised persons to operate, move or interfere with the Equipment.
4.5 The Equipment must not be used for any unlawful purpose.
5. Food and Stored Goods
5.1 The Customer is solely responsible for all food, beverages, stock, products and other items placed inside the Equipment.
5.2 The Customer is responsible for ensuring that all goods stored inside the Equipment are suitable for refrigerated storage.
5.3 The Customer must ensure that food and other perishable goods are handled, stored and transported in accordance with all applicable food safety requirements.
5.4 Khaoz Rentals is not responsible for loss, spoilage or deterioration of food, beverages, stock or other goods stored inside the Equipment where such loss results from the Customer's actions, incorrect use, overloading, inadequate power supply, failure to follow instructions or circumstances outside Khaoz Rentals' reasonable control.
6. Power Supply
6.1 Where the Equipment requires an external power supply, the Customer is responsible for ensuring that an appropriate and safe power source is available.
6.2 The Customer must not connect the Equipment to an unsuitable, damaged or unsafe electrical supply.
6.3 Khaoz Rentals is not responsible for damage to the Equipment caused by an inadequate, incorrect or unsafe power supply provided by the Customer.
6.4 The Customer must immediately notify Khaoz Rentals if the Equipment stops operating correctly or if any electrical or refrigeration issue occurs.
7. Care and Security
7.1 The Customer is responsible for the Equipment from the time of delivery or handover until it is collected or returned to Khaoz Rentals.
7.2 The Customer must take reasonable steps to protect the Equipment from theft, vandalism, accidental damage, weather-related damage and misuse.
7.3 The Customer must not move the Equipment from the agreed location without prior written approval from Khaoz Rentals.
7.4 The Customer must not place the Equipment in a garage, enclosed structure or other unsuitable location without prior approval from Khaoz Rentals.
8. Damage, Cleaning and Loss
8.1 The Customer is responsible for any loss or damage to the Equipment occurring during the hire period, except to the extent caused by Khaoz Rentals or otherwise required by applicable law.
8.2 The Customer must return the Equipment in a clean and reasonable condition.
8.3 Additional charges may apply for excessive cleaning, damage, missing equipment, lost keys or other items supplied with the Equipment.
8.4 Where additional charges apply, Khaoz Rentals may provide the Customer with an invoice detailing the relevant costs.
8.5 The Customer must not attempt to repair the Equipment. Any fault or damage must be reported to Khaoz Rentals as soon as reasonably possible.
9. Equipment Faults
9.1 The Customer must notify Khaoz Rentals as soon as possible if the Equipment develops a fault or stops operating correctly.
9.2 The Customer must not attempt to repair, modify or dismantle the Equipment.
9.3 Khaoz Rentals will take reasonable steps to investigate and, where appropriate, repair or replace faulty Equipment.
9.4 Khaoz Rentals will not be responsible for loss of or damage to goods stored inside the Equipment to the extent permitted by law.
10. Prohibited Use
The Customer must not:

• use the Equipment for any unlawful purpose;

• overload the Equipment;

• intentionally damage or misuse the Equipment;

• modify or tamper with the Equipment;

• move the Equipment without permission;

• allow unauthorised persons to operate or interfere with the Equipment;

• use the Equipment in an unsafe manner; or

• use the Equipment in a manner inconsistent with its intended purpose.

11. Customer Responsibilities
11.1 The Customer is responsible for complying with all applicable laws, regulations, council requirements and food safety requirements relating to their use of the Equipment.
11.2 The Customer is responsible for obtaining any permits, approvals or permissions required for the intended use or placement of the Equipment.
11.3 The Customer must provide Khaoz Rentals with reasonable access to the Equipment where access is required for inspection, maintenance, repair or collection.
12. Liability
12.1 Nothing in these Hire Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
12.2 To the extent permitted by law, Khaoz Rentals will not be liable for indirect or consequential loss arising from the Customer's use of the Equipment.
12.3 The Customer remains responsible for the goods and property stored inside the Equipment.
13. Termination
13.1 Khaoz Rentals may terminate a hire arrangement where the Customer materially breaches these Hire Terms, uses the Equipment in an unsafe or prohibited manner, fails to make required payments, or otherwise places the Equipment or other persons at unreasonable risk.
13.2 If the hire is terminated due to the Customer's breach, the Customer may remain responsible for outstanding hire fees, collection costs, cleaning costs, repair costs or other reasonable costs incurred by Khaoz Rentals, to the extent permitted by law.
14. Changes to These Terms
Khaoz Rentals may update these Hire Terms from time to time. The version applicable to a booking will generally be the version in effect at the time the booking is confirmed, unless otherwise required by law.
15. Governing Law
These Hire Terms are governed by the laws of New South Wales, Australia, and the parties submit to the jurisdiction of the courts of New South Wales.
